General Terms and Conditions: |
| 1. |
Cash Rebate Scheme |
| A. |
"Cash Rebate" is applicable to Principal Card Cardholders and Supplementary Card Cardholders ("Eligible Credit Cards") of The Link Happy Visa Card ("Happy Card") issued by Dah Sing Bank ("the Bank"). The "Cash Rebate" will be credited to the credit card accounts respectively. |

"Cash rebate" is only applicable to retail purchase and Octopus Automatic Add Value Service amount ("Eligible transactions") and excluding the following transactions, including but not limited to the rental payment of The Link’s monthly car park or retail shops through the direct debit authorization service, cash advance, autopay, "Happy Installment" installment amount, Cash-in Plan amount, Branch Cash-in, balance transfer amount, Stocks Investment Savings Plan, "Payeasy" bill payment amount, "Jet Payment" payment amount, tax payment, interest-free monthly installment amount, cheque payment (if applicable), bank handling fee (including but not limited to annual fee, financial charge, late fee and cash advance handling fee etc), casino transactions, unposted / cancelled / refunded and all unauthorized transactions. The "Cash rebate" offer shall be subject to the terms and conditions of the Cardholder Agreement. The Bank reserves the final decision on the applicability of the "Cash rebate". |
| C. |
Cardholders can earn HK$0.1 cash rebate (i.e. 1X basic cash rebate) for every HK$25 eligible transaction with Happy Card. |
| D. |
Cardholders can earn extra HK$0.1 birthday cash rebate (i.e. extra 1X cash rebate) for every HK$25 transaction with Happy Card made on birthday. |
| E. |
Transactions made at designated merchants at the designated The Link’s shopping malls ("Happy Merchants") and hourly car parks operated by The Link Management Limited ("The Link") with Happy Card: |

(i) Happy Platinum Card: For every HK$25 transaction, HK$0.3 cash rebate (including HK$0.1 "basic cash rebate (i.e. 1X basic cash rebate) and HK$0.2 extra cash rebate" (i.e. extra 2X cash rebate) will be offered；
(ii) Happy Classic Card: For every HK$25 transaction, HK$0.2 cash rebate (including HK$0.1 "basic cash rebate (i.e. 1X basic cash rebate) and HK$0.1 "extra cash rebate" (i.e. extra 1X cash rebate) will be offered；
Each eligible Principal and Supplementary credit card account is entitled to a maximum of HK$100 "extra cash rebate" in each monthly statement. (If the "extra cash rebate" earned reaches the maximum monthly amount, cardholders will still be entitled to "basic cash rebate" for the eligible transactions.) |

Calculation of Cash Rebate: |

(i)"Basic cash rebate" - The Bank will calculate the cash rebate by first dividing the amount of each eligible transaction by HK$25 (the number will be rounded off to the nearest integer), then multiplying the number by HK$0.1 (i.e. 1X cash rebate); the total "basic cash rebate" earned from all eligible transactions will then be rounded into the nearest dollar. If the total "basic cash rebate" earned is more than HK$0 but not less than HK$1, it will be rounded to HK$1. |

(ii)"Extra cash rebate" - The Bank will calculate the cash rebate by first dividing the amount of each eligible transaction by HK$25 (the number will be rounded off to the nearest integer), then multiplying the number by HK$0.2 (Platinum Card: 2X cash rebate) or HK$0.1 (Classic Card: 1X cash rebate); the total "extra cash rebate" earned from all transactions will be rounded into the nearest dollar. If the total "extra cash rebate" earned is more than HK$0 but less than HK$1, it will be rounded to HK$1. |
| G. |
"Extra cash rebate" will be credited to eligible credit cards account after statement cut date and will be shown on the next monthly statement. Relevant credit card accounts should remain valid and in good standing status on the date the cash rebate credited to the accounts. |
| H |
"Cash rebate" earned will be used for payment of new transaction items, it cannot be converted into cash or withdrawn as cash advance and is not combinable nor transferable (include but not limited to different credit card of the same Cardholder or Supplementary card account). |
| I. |
If the single transaction is below HK$25, "Cash rebate" (including "basic cash rebate", "birthday cash rebate" and "extra cash rebate") will not be offered. |
| J. |
If any related transaction is cancelled after cardholders received "Basic Cash Rebate" or "Birthday Cash Rebate", cardholders are required to reimburse the Bank for the whole amount of the relevant cash rebate. The Bank has the right to debit the relevant cash rebate from cardholders' relevant credit card accounts without further notice. The Bank will calculate the reimbursement by dividing the amount of the cancelled transaction by HK$25 (the number will be rounded off to the nearest integer), then multiplying the number by HK$0.1 (1X Basic Cash Rebate). If more than one related transactions are cancelled in the monthly statement, the Bank will calculate the total amount of reimbursement by adding up the relevant cash rebate of all cancelled transactions. The final amount will be rounded off to the nearest dollar.

If a transaction of HK$1,320.50 is cancelled, the cardholder is required to reimburse HK$5 to the Bank.
* The above calculation is also applicable to Happy Classic Card, whereas the extra cash rebate for Classic Card is 1X (i.e. HK$0.1).

| 2. |
The list of designated The Link shopping malls and "Happy Merchant" are jointly determined by the Bank and The Link. The Bank and The Link reserve the right to amend the list at any time. Customers can refer to the latest list of the designated The Link shopping malls and "Happy Merchant" in the Bank's website. The Bank will calculate the "extra cash rebate" based on respective Happy Merchants and their acquiring bank's credit card settlement system setting. In case such system setting was being changed and induced cardholders fail to enjoy the "extra cash rebate", the Bank will not bear any responsibility. In case of the "Happy Merchants" List is not refreshed on time and induced cardholders fail to enjoy the "extra cash rebate", or should any disputes arouse concerning the list, the decision of the Bank shall be final. The Bank reserves the right to determine the validity of any transactions at "Happy Merchants" and amend the terms and conditions at any time without further notice. In case of disputes, the decision of the Bank shall be final. |
| 3. |
Upon meeting the required spending amount in designated The Link Shopping Malls (one of the transactions must be settled with Happy Card), Cardholder will be offered an additional one hour free parking ("Extra Parking Offer") on top of the regular parking offer available in the designated The Link Shopping Malls. "Extra Parking Offer" is bound by relevant terms and conditions. For details, please contact The Link's Customer Service Department or The Link’s Customer Service Hotline at 3168 0080. The Bank reserves the final rights to amend these terms and conditions at any time. All matters and disputes will be subject to the final decision of the Bank. |
| 4. |
If customers wish to settle The Link car park fee or retail rentals ("Payments") with Happy Card through Direct Debit Authorization, cardholders are required to complete and return the "Credit Card Direct Debit Payment Authorization Form" to the Bank when applying the credit card. Otherwise, Cardholders can also complete and return the form to The Link after the card is issued. The Bank will transfer/debit from the relevant credit card accounts in settlement of the Payments in favor of The Link in accordance with the instructions receiving from The Link from time to time. Please contact The Link for any enquiries about this service. This service is applicable to Principal and Supplementary Cardholders and bound by relevant terms and conditions. For details, please refer to "Credit Card Direct Debit Authorization Form". For the payment settled through this service, no cash rebate will be offered. |
| 5. |
Monthly car park HK$35 rental rebate offer ("HK$35 rental rebate offer") |
| A. |
The promotion period for "HK$35 rental rebate offer" ends at 31 December, 2012 ("Promotion Period"). |
| B. |
"HK$35 rental rebate offer" is only applicable to the Principal Cardholders of Dah Sing The Link Platinum Credit Card. Happy Card Principal Cardholder is eligible for "HK$35 rental rebate offer" upon settling the Link’s monthly car park rental by direct debit authorization service with the Happy Platinum Card and made eligible transaction of HK$3,500 or above (as defined in Clause C below) in the same statement. |
| C. |
"Eligible Transaction" is only applicable to local and overseas retail purchase and cash advance and is not applicable to the other transactions, include but not limited to the rental payment of The Link’s monthly car park or retail shops through the direct debit authorization service, autopay, recurring billing transactions (e.g. Octopus Automatic Add Value Service transaction, Autotoll top up etc), "Happy Installment" installment amount, Cash-in Plan installment amount, Branch Cash-in, Stocks Investment Savings Plan, balance transfer amount, "Payeasy" bill payment amount, tax payment, "Jet Payment" payment amount, interest-free monthly installment amount, gift redemption fee (if applicable), cheque payment (if applicable), bank handling fee (including but not limited to annual fee, financial charge, late fee and cash advance handling fee etc), casino transactions, unposted / cancelled / refunded and all unauthorized transactions. Eligible spending of Supplementary Card account will be combined to the Principal Card account. |
| D. |
Each Happy Platinum Card Cardholder is entitled to a maximum of "HK$35 rental rebate offer" for each statement during the promotion period. |
| E. |
If Principal Card Cardholder holds more than one Happy Platinum Card, and those credit cards have met the requirement of "HK$35 rental rebate offer", then only one of those credit card accounts can enjoy "HK$35 rental rebate offer". |
| F. |
The Bank will verify the validity of the Cardholder's credit card transaction record to confirm the Principal Cardholder’s eligibility for entitling the "HK$35 rental rebate offer". |
| G. |
The Bank will settle the eligible transactions of the Happy Platinum Card at the last working day of each month, and the relevant "HK$35 rental rebate offer" will be credited automatically and reflected in the next statement. |
| H. |
"HK$35 rental rebate offer" will be used for payment of new transaction items, it cannot be converted into cash or withdrawn as cash advance and is not combinable nor transferable (include but not limited to different credit card of the same Cardholder or supplementary card account). |
| I. |
If Principal Cardholder cancels/refunds the relevant eligible transaction (including transactions of Supplementary Card) after the "HK$35 rental rebate offer" being credited to the card account, the Bank has the right to debit the amount which is equivalent to the value of "HK$35 rental rebate offer" from the Cardholder's Credit Card account without further notice. |
| J. |
The Principal Card account must be valid and in good standing status at the time of cash rebate credit. If Cardholder is failed to meet the requirement, the Bank reserves the right to fortfeit the "HK$35 rental rebate offer"and other cash rebate without any prior notice. |
| 6. |
The Bank reserves the rights to amend these terms and conditions and / or amend or terminate any offer at any time without prior notice. All matters and disputes will be subject to the final decision of the Bank. |
| 7. |
In case of any discrepancies between the Chinese and English versions of the terms and conditions, the English version shall prevail. |

Terms and Conditions for Welcome Gift: |
| I. |
Promotion Period is valid from now until May 31, 2012 ("Promotional Period"). Welcome Gifts are only applicable to the brand new Dah Sing Bank Credit Card cardholders who in the past 12 months have not held and/or cancelled any principal card or supplementary card of any card type issued by Dah Sing Bank. Each new Principal Card Cardholder can only entitle to welcome gift ONCE only regardless of the number of Dah Sing The Link Happy Visa Card applied. |
| II. |
For Principal Card Cardholder who chooses "16 inches Black Foldable Bicycle", "Rasonic Thermo Pot" or "HK$300 Cash Rebate", he/she will be entitled to the Welcome Gift upon accumulated retail purchase or cash advance of HK$3,500 or above and being posted to the relevant credit card account within the first 2 months from card-issuance. |
| III. |
The Principal cardholders who successfully apply for Dah Sing The Link Happy Visa Card can enjoy up to HK$60,000 and 15-month Free Interest and Service Charge Cash-In Plan without any spending requirement. The Cash-in amount of the Plan is subject to the final approved credit limit of Dah Sing Bank Credit Card account. The Cash-in amount is up to 90% of credit limit (the minimum amount required is HK$3,000 while the maximum is HK$60,000). Dah Sing Bank (the "Bank") has the absolute discretionary right to determine the final Cash-In amount of the cardholder and is not obliged to provide reasons. A confirmation letter will be mailed to the Principal cardholder within 1 month whilst his/her credit card has been approved. Cardholder may contact Dah Sing Bank Customer Service Hotline 2828 8002 to accept the Cash-In offer or by completing the confirmation letter and return to the bank with required documents by mail / fax within 60 days since card issuance. Upon receipt of all necessary documents, the Bank requires approximate 2 weeks to process the request and disburse the fund to the cardholder's designated personal Hong Kong dollar currency bank account (the "Relevant Bank Account"). The receiving bank may deduct the handling fee from the Relevant Bank Account. The Bank is not liable for the mentioned handling fee or any interest or other expense caused by this. The cardholder has to arrange with receiving bank for the expense or interest (if applicable) directly. The Bank will debit the Credit Card Account (the "Relevant Account") with the approved Cash-In amount by 15 consecutive monthly installments, commencing from such date as the Bank may prescribe at its discretion. The Bank will debit an amount equivalent to the Cash-In amount from the credit limit of the Relevant Account until the last installment has been debited. The Bank will proportionally increase the deducted credit limit every month after the Bank has successfully debited the Relevant Account with the Cash-In amount due. No financial charge will be charged provided that the cardholder makes full payment of the credit card statement balance on or before the payment due date. For cardholder who makes partial payment of the credit card statement balance, cardholder shall pay a finance charge on any monthly installment amount due but unpaid at the prevailing interest rate of the Relevant Account. On default of payment of any monies due under the Relevant Account or in case of breach of any provisions of the applicable terms and conditions governing the use of Dah Sing Credit Card Cardholder Agreement ("Agreement") or any of these terms and conditions by cardholder or in case of cancellation or termination of the Relevant Account or the Plan for whatever reasons, all outstanding installments or balance or monies owing under these terms and conditions shall be immediately due and payable by cardholder and shall at the absolute discretion of the Bank, be debited against the Relevant Account and a Cash-In plan cancellation fee of HK$300 will be charged by the Bank, therefore, the Agreement shall apply to all the said installments or balance. The Bank has the right to accept or reject any application without providing any reason. The Plan is not applicable for "Credit Card Bonus Point Scheme", "Instant Cash Reward" / "Cash Rebate", "Mileage Program", "JFT Dollars" and any other Bonus Point or Cash Rebate Reward Program. Even if these terms and conditions have to be stipulated by other articles, the Bank has the right to inform the cardholder to suspend or terminate the Plan. These terms and conditions shall form part of the Agreement and shall be construed accordingly. In case of any inconsistency discrepancy between these terms and conditions and the Agreement, these terms and conditions shall prevail. |
| IV. |
Gift choice cannot be changed once confirmed. |
| V. |
The valid accumulated spending for welcome gift include retail purchase, cash advance, "Happy Installment" installment amount, Cash-in Plan installment amount, Branch Cash-in, autopay, recurring billing transactions, balance transfer amount posted in Dah Sing The Link Happy Visa Card account, Stocks Investment Savings Plan, "Payeasy" bill payment amount, "Jet Payment" payment amount, interest-free monthly installment amount, gift redemption fee (if applicable), cheque payment (if applicable), Octopus Automatic Add Value Service amount and rental payment of The Link’s monthly car park or retail shops through the direct debit authorization service. But excluding the following transactions, including but not limited to bank handling fee (including but not limited to annual fee, financial charge, late fee and cash advance handling fee etc), casino transactions, unposted / cancelled / refunded and all unauthorized transactions. Retail purchase and cash advance of Supplementary Card will be combined to the Principal Card account. The Bank reserves the final decision for determining the eligibility of the transaction to be included in the welcome gift. |
| VI. |
The Bank will determine the Cardholder's eligibility for entitlement of the welcome gift based on the Cardholders' transaction records held with the Bank. |
| VII. |
Cardholders are required to keep all relevant original sales slips. In case of any disputes, the Bank reserves the right to request Cardholders to submit the relevant original sales slips for inspection. All sales slips submitted to the Bank will not be returned. |
| VIII. |
The welcome gift redemption letter for "16 inches Black FOldable Bicycle" and "Rasonic Thermo Pot" will be sent to the eligible Principal Card Cardholder within one month upon fulfilling the spending requirement and the relevant Credit Card account must be valid and in good standing status at the time of issuing the redemption letter in order to be entitled to the welcome gift. Gift redemption is subject to the respective terms and conditions, these terms and conditions are set out on the redemption letter. |
| IX. |
Welcome gift of "HK$300 Cash Rebate" will be credited to the eligible Principal Card Cardholder within one month upon fulfilling the spending requirement. The relevant credit card account must be valid and in good standing status at the time of cash rebate credit. |
| X. |
Cash rebate will be credited into the Principal Cardholder's Credit Card account in form of credit card free spending credit. Credit card free spending credit will be used for payment of new transaction items, it is not transferable, refundable or cannot be exchanged for cash. |
| XI. |
Welcome Gifts listed above are on a first-come-first-serve basis while stocks last. In the event that the gift item is out of stock, the Bank reserves the right to substitute the welcome gift with another offer without prior notice. |
| XII. |
The photos of the welcome gifts are for reference only. The suppliers of the gifts are solely responsible for the quality, availability and warranty of the products supplied, and the Bank has no liability for the quality, availability and warranty of the same. Any dispute or complaint in respect of the products, services and / or information should be directed to the relevant merchants. |
| XIII. |
The reference retail price for the gifts is for reference only, and is not determined by the Bank. The Bank will not be responsible for any difference between the reference retail price and the real market price of the welcome gifts. |
| XIV. |
If principal cardholder cancels his/her new Credit Card within 13 months from card-issuance date, the Bank reserves the right to debit a handling fee of HK$300 to the relevant Principal Card account without prior notice. |
| XV. |
The Bank reserves the right to amend these terms and conditions or cancel the offer at any time without prior notice. |
| XVI. |
All matters and disputes will be subject to the final decision of the Bank. |
| XVII. |
In case of any discrepancy between the English and Chinese versions of these Terms and Conditions, the English version shall prevail. |
