Terms and Conditions for the Virtual Assistant service of Dah Sing Bank, Limited


  1. These terms and conditions ("Terms") govern your use of Virtual Assistant, an automated chatbot service provided by Dah Sing Bank, Limited (the "Bank" or "We", which includes our successors and assigns) to respond to general enquiries about our e-Banking / Mobile Banking services and to provide you with assistance and support in reporting lost card (the "Service"). These Terms are in addition to and shall be read in conjunction with, if applicable, our Master Terms and Conditions / Master Terms and Conditions for VIP Banking Services of the Bank, the Important Notices as set out at https://www.dahsing.com/html/en/other/internet_security.html, and Notice to Customers relating to Customers' Data (the "Notice") (collectively, the "Existing Terms"). Unless otherwise specified, the provisions of these Terms prevail if there is any inconsistency between them and the provisions of the Existing Terms with respect to the Service.
    BY CLICKING "Continue" AND USING the Service, YOU ACCEPT AND ARE DEEMED TO ACCEPT THESE TERMS AND THE EXISTING TERMS.
  2. By uploading, submitting, posting or transmitting data, material or information via the Service, you agree to grant the Bank a worldwide perpetual irrevocable non-exclusive royalty free and sub-licensable license to use, copy, reproduce, process, adapt, publish, create derivative work from, translate, transmit, host and disseminate your content in any media, technology, or form. We reserve the right (but not obliged) to remove, pre-screen, review, flag, filter, modify or refuse any of your content at our sole and absolute discretion.
  3. You may choose to use the Service on an anonymous basis and you are not required to provide any personal information to the Bank while using the Service to make general enquiries. However, we may request you to provide information about yourself or your account for authentication purpose before we can respond to your enquiries about application for reporting lost card. If you provide your personal information to the Bank, the Bank may collect, use, retain and disclose such information in accordance with the Privacy Policy Statement available at https://www.dahsing.com/html/en/other/disclaimer_privacy_policy_statement.html and the Notice (collectively, the "Privacy Notices"). By using the Service and accepting these Terms, you agree and acknowledge that you have read, understood and agreed to the Privacy Notices.
    To preserve the confidentiality of your personal information, please avoid disclosing any personal or account information when using the Service unless you are being asked by the Bank to provide such information for authentication purpose.
  4. You acknowledge and consent to the recording of all communications via the Service (including any documents or files shared, annotated and exchanged). We will also keep records of such communications in line with applicable legal and regulatory obligations and the Privacy Notices. We may use the recorded communications (or if applicable, transcripts of any voice conversations made under the Service) in any dispute and you agree not to challenge their validity, admissibility or enforceability on the basis that they are in electronic form. You agree that the recorded communications remain our property, and may be used for training, quality control and dispute handling purposes.
  5. The Service is an automated service, any information provided under the Service is for reference only. Such information does not constitute any offer for any products or services and is not intended to provide professional investment or other advice. Except for reporting lost card, the Service is not a channel for carrying out specific actions or instructions including but not limited to execution of financial transactions, order taking, complaint lodging or direct marketing preference updating. Please refer to other channels designated by the Bank for specific actions or instructions.
  6. The Service is provided on an "as is" basis. To the fullest extent permitted by applicable law, the Bank disclaims any representation, warranties or agreement, whether express or implied, in relation to the Service or any information provided thereunder. Without prejudice to the foregoing, the Bank makes no representations or warranties as to the accuracy, quality, completeness, timeliness, adequacy, security, reliability, suitability, accessibility, compatibility or validity of the Service or any information provided thereunder, and that any error or defects in the Service or any information provided thereunder will be timely corrected or at all.
  7. To the fullest extent permitted by applicable law, the Bank will not be liable for any loss or damage, whether direct, indirect, special, incidental or consequential losses, which you or any other person may incur or suffer arising from or in connection with the use of the Service, except to the extent that such loss or damage is directly and solely caused by our gross negligence or wilful default.
  8. You further accept and acknowledge that any communications via the Service may not be encrypted and may contain personal information and/or information in relation to your accounts, and we shall not be responsible or liable to you or any other person for any possible release, loss or interception of such information.
  9. You agree to use the Service or any information provided thereunder in accordance with these Terms and not to use them in any way that is unlawful or in breach of any applicable laws or promotes illegal activities, or that contravenes or infringes any rights of the Bank or any other persons. You shall indemnify the Bank against all losses and damages whatsoever and howsoever caused that may be incurred by the Bank in connection with any improper use of the Service by you.
  10. We reserve the right to modify, suspend or terminate the Service or its use by you at any time without giving prior notice or reason if we reasonably consider necessary or advisable to do so.
  11. These Terms constitute the entire agreement between you and the Bank with respect to the use of the Service and the content of it. No person other than you and the Bank will have any right under the Contracts (Rights of Third Parties) Ordinance to enforce or enjoy the benefit of any of the provisions under these Terms.
  12. These Terms may be amended or modified by the Bank at its sole and absolute discretion at any time and from time to time by posting the revised version on the website of the Bank. You hereby agree that your access to or use of the Service after the relevant effective date of such revised Terms shall constitute your acceptance of such revised Terms.
  13. All offers, products and services mentioned under the Service are subject to the respective terms and conditions.
  14. These Terms shall be governed by and construed in accordance with the laws of Hong Kong Special Administrative Region ("Hong Kong") and you agree to submit to the non-exclusive jurisdiction of the Hong Kong courts.

The Chinese version of these Terms is for reference only. If there is any conflict between the English and the Chinese versions of these Terms, the English version shall prevail.
